Enugu Assembly proposes new tenancy protection bill

The Enugu State House of Assembly has introduced a bill aimed at regulating tenancy fees and landlord charges, seeking to curb excessive costs and unfair rental practices in the state.

Titled “The Bill for a Law to Amend the Landlord and Tenant Law, CAP. 101, Laws of Enugu State, 2024,” the proposed legislation was sponsored by Hon. Okey Mbah, who represents the Nkanu East State Constituency. It passed its first reading on Tuesday.

The bill introduces key reforms to protect tenants, including:

Capping agency and legal fees at 10% of the rent, preventing excessive charges.

Abolishing caution fees, which landlords often fail to refund.

Strengthening eviction laws, ensuring fair legal procedures before a tenant can be removed.

Regulating property agents, allowing only certified professionals to operate as agents or property managers.

Imposing penalties for violations, with offenders facing fines of up to ₦500,000, a six-month jail term, or both.

Speaking on the bill, Hon. Okey Mbah emphasized that it reflects the concerns of Enugu residents and is expected to receive strong backing from fellow lawmakers.

If passed into law, the bill could significantly reshape landlord-tenant relationships in Enugu, offering greater protection for renters and ensuring fairer housing practices across the state.
